1. Acceptance of Terms

Welcome to DateTrak.

These Terms of Service (“Terms”) constitute a legal agreement between you and DateTrak LLC governing your access to and use of the DateTrak mobile application and related services.

By creating an account, accessing, or using DateTrak, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree with these Terms, you should not access or use DateTrak.

2. Purpose of DateTrak

DateTrak is designed to assist individuals and businesses with organizing inventory and tracking product expiration information.

DateTrak is intended to improve inventory visibility, reduce waste, and support responsible inventory management.

DateTrak is an organizational tool only. It does not replace professional judgment, physical product inspection, workplace procedures, regulatory requirements, manufacturer guidance, or applicable laws.

3. User Accounts

Certain DateTrak features require a user account. You are responsible for maintaining the confidentiality and security of your account credentials.

You agree to:

• Provide and maintain accurate account information
• Protect your login credentials from unauthorized access
• Notify DateTrak LLC if you suspect unauthorized use of your account
• Accept responsibility for activity occurring through your account

You may not impersonate another person, use another person’s account without authorization, or create an account for unlawful or fraudulent purposes.

4. Acceptable Use

You agree to use DateTrak only for lawful purposes and in a manner consistent with these Terms.

You agree not to:

• Reverse engineer, decompile, disassemble, or attempt to derive DateTrak’s source code except where such restrictions are prohibited by law
• Attempt to gain unauthorized access to DateTrak, user accounts, servers, databases, or related systems
• Interfere with, disrupt, overload, damage, or impair DateTrak’s operation or security
• Introduce malware, malicious code, automated attacks, or other harmful material
• Circumvent access controls, subscription requirements, or security measures
• Copy, sell, sublicense, rent, lease, distribute, or commercially exploit DateTrak except as expressly authorized
• Use DateTrak in violation of any applicable law, regulation, contractual obligation, or third-party right

5. User Data

You retain ownership of the inventory information and other content you enter into DateTrak.

You grant DateTrak LLC the limited rights necessary to process, store, display, transmit, and back up that information solely for the purpose of providing, maintaining, securing, and improving DateTrak’s functionality.

This processing may include:

• Inventory organization and display
• Product, location, expiration-date, and barcode associations
• Optional cloud backup and restore functionality
• Account authentication and security
• Customer support and troubleshooting

You are responsible for ensuring that information entered into DateTrak is accurate, lawful, and does not violate the rights of another person or organization.

6. Subscriptions and Payments

Certain DateTrak features may require a paid subscription or purchase.

Purchases and subscriptions made through Google Play, the Apple App Store, or another authorized marketplace are processed and managed by that marketplace.

Pricing, billing periods, automatic renewals, cancellations, refunds, taxes, and payment processing are subject to the terms and policies of the applicable marketplace.

Unless canceled through the applicable marketplace before the end of the current billing period, a subscription may automatically renew according to the terms presented at the time of purchase.

DateTrak LLC does not receive or store full payment-card numbers, banking credentials, or other sensitive payment information processed by an app store or payment provider.

7. Service Availability

DateTrak may include both offline functionality and features that depend on internet access, cloud services, authentication systems, app stores, or other third-party providers.

Although DateTrak LLC makes reasonable efforts to provide a reliable service, uninterrupted or error-free availability cannot be guaranteed.

Temporary interruptions, delays, or limitations may occur because of maintenance, software updates, internet connectivity, device compatibility, third-party service failures, security events, or circumstances beyond DateTrak LLC’s reasonable control.

8. Disclaimer of Warranties

To the maximum extent permitted by applicable law, DateTrak LLC disclaims all warranties and representations, whether express, implied, statutory, or otherwise.

This includes implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, availability, and suitability for a particular inventory workflow or business purpose.

DateTrak LLC does not warrant that DateTrak will always be uninterrupted, secure, error-free, compatible with every device, or that all entered or displayed information will be accurate.

Some jurisdictions do not permit certain warranty exclusions, so some of the exclusions above may not apply to you.

9. Limitation of Liability

DateTrak assists users with inventory organization and expiration-date tracking. Users remain responsible for verifying all information and making final inventory decisions.

Users remain responsible for:

• Verifying product names, descriptions, and expiration dates
• Inspecting products before use, sale, transfer, or disposal
• Monitoring product condition and storage requirements
• Following employer policies and workplace procedures
• Following manufacturer instructions and safety guidance
• Complying with all applicable laws, regulations, and industry standards

To the maximum extent permitted by applicable law, DateTrak LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages.

This includes losses arising from inaccurate or incomplete user-entered information, missed expiration dates, spoiled or unusable products, inventory loss, lost profits, lost revenue, business interruption, loss of data, unauthorized account access, reliance on DateTrak, or misuse of the application.

To the maximum extent permitted by applicable law, DateTrak LLC’s total liability arising out of or relating to DateTrak or these Terms will not exceed the amount you paid to DateTrak LLC for access to DateTrak during the twelve months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some limitations above may not apply to you.

10. Updates

DateTrak LLC may release updates, patches, corrections, or new versions of DateTrak to improve functionality, security, compatibility, reliability, or legal compliance.

Some updates may be required for continued access to certain features or services.

Features may be added, modified, limited, or discontinued when reasonably necessary for technical, operational, security, business, or legal reasons.

11. Termination

You may stop using DateTrak at any time. Subscription cancellation must be completed through the applicable app store or payment provider.

DateTrak LLC may suspend, restrict, or terminate access to DateTrak when reasonably necessary because of:

• A violation of these Terms
• Fraudulent, unlawful, abusive, or harmful activity
• Threats to application, account, or service security
• Nonpayment where payment is required
• A legal requirement, court order, or request from a governmental authority
• Discontinuation of DateTrak or a related service

Sections that by their nature should continue after termination, including ownership, disclaimers, limitations of liability, and dispute-related provisions, will remain effective.

12. Changes to These Terms

DateTrak LLC may update these Terms when DateTrak’s functionality, business practices, services, or legal obligations change.

When these Terms are revised, the Version, Effective Date, or Last Updated date shown near the top of this page may also be updated.

Continued use of DateTrak after revised Terms become effective constitutes acceptance of the revised Terms.
